1. Acceptance of Terms
By accessing or using ModPackQT ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including visitors, registered users, and any other persons who access the Service.
2. Description of Service
ModPackQT is a web-based Modbus Master and Slave simulator that enables users to read and write Modbus device registers over RTU serial and TCP/IP protocols. The Service includes connection profile management, register visualization, AI-assisted document parsing, and slave device simulation capabilities.
3. User Accounts
To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
A limited trial period is available without registration. After the trial period expires, you must create an account to continue using the Service.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable local, state, national, or international law or regulation
- Interfere with or disrupt the Service or servers connected to the Service
- Attempt to gain unauthorized access to other accounts, systems, or networks
- Use the Service to send unsolicited communications or spam
- Transmit any malicious code, viruses, or destructive content
- Impersonate any person or entity or misrepresent your affiliation
5. Intellectual Property
The Service and its original content, features, and functionality are owned by ModPackQT and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6. User Data
Connection profiles and register configurations that you save through the Service are stored securely in our cloud infrastructure. Real-time measurement and register data is processed in your browser session and is not transmitted to or stored on our servers unless you explicitly choose to save it.
You retain ownership of any data you input into the Service. We do not claim any intellectual property rights over your Modbus configurations, register maps, or device data.
7. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
For users requiring guaranteed uptime in critical environments, Local Mode provides offline operation capability independent of our cloud infrastructure.
8. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. ModPackQT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
ModPackQT is a simulation and testing tool. It is not intended for use as a primary control system for safety-critical applications. Users are responsible for ensuring appropriate safety measures are in place when connecting to industrial equipment.
9. Indemnification
You agree to indemnify and hold harmless ModPackQT, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
